Terms of Service

These Terms of Service ("Terms") govern your access to and use of briff at briff.ai and its related services (the "Service"), operated by [OPERATOR] ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.


1. Agreement

By accessing or using briff.ai, you agree to be bound by these Terms. If you are using the Service on behalf of a company or other entity, you represent that you have authority to bind that entity, and "you" refers to that entity. These Terms incorporate our Privacy Policy and any policies or limits referenced within the product.

2. The Service

briff produces customer-discovery briefs. You describe a target customer or idea; we research that customer's public discussions across the web (including communities such as Reddit, Hacker News, and Indie Hackers) and synthesize a written brief that may include pain points, verbatim quotes with citations, named and reachable prospective customers drawn from public posts, willingness-to-pay benchmarks, distinctive vocabulary, and ranked positioning angles.

The Service has two parts:

  • A free idea triage (viability check), offered at our discretion as a brief, automated assessment of an idea you submit.
  • A paid brief, delivered as a hosted HTML document and a downloadable PDF, on a target turnaround of approximately 24 hours from the start of generation. Turnaround is a target, not a guarantee.

3. Eligibility

You must be at least 16 years old, or the age of digital consent in your jurisdiction if higher, to use the Service. By using briff, you confirm that you meet this requirement and that you are not barred from using the Service under any applicable law.

4. Accounts

Paid features require an account, which we provide through our authentication processor (Clerk). You are responsible for safeguarding your credentials and for all activity under your account. You agree to provide accurate registration information and to notify us promptly at legal@briff.ai of any unauthorized use. You may not share an account across multiple individuals except where your plan expressly permits it.

5. Credits, Plans, and Payment

briff is sold on a credit basis. Current plans:

  • One credit is consumed when a brief enters generation.
  • Prices are in U.S. dollars and exclusive of taxes unless stated otherwise at checkout.
  • Payments are processed by Polar.sh, acting as our Merchant of Record. Polar.sh is the seller of record for your purchase, handles billing and applicable taxes (including VAT/GST), and its terms apply to the payment transaction. We do not receive or store your full payment-card details.
  • We may change plans, prices, or credit terms prospectively. Changes do not affect credits already purchased except as required to deliver the Service.

6. Refunds, Quality, and Cancellation

  • One-time purchases (Single, Pack): you may request a full refund within 7 days of purchase, provided you have not redeemed all of the briefs in your purchase. Once every credit in a one-time purchase has been redeemed, that purchase is no longer refundable, except where required by law.
  • Subscriptions: you may cancel at any time. Cancellation stops future renewals but does not refund the current month; you keep the credits already issued for that cycle. Subscription credits follow the reset and stacking rules described in-product.
  • Quality guarantee: we will not deliver a brief that fails our internal quality check. A brief that fails is regenerated at our cost, so you do not receive broken output. If we are unable to deliver a brief due to our fault, we will refund the corresponding credit.

Refund requests are handled through legal@briff.ai and, where applicable, the Merchant of Record.

7. Your Content and Inputs

You retain ownership of the inputs you submit (idea descriptions, target-customer descriptions, prompts, and any materials you provide). You grant us a limited, non-exclusive, worldwide license to use, process, and transmit those inputs solely to operate and deliver the Service to you, including transmitting them to the subprocessors listed in our Privacy Policy.

You represent and warrant that you have the right to submit your inputs and that doing so does not violate any law or any third party's rights. We do not use your inputs to train AI models.

Free triage and the public library. Paid briefs are private to you. If you submit a free triage but do not complete a paid brief order within 7 days, we may publish that triage in our public library, using the persona or idea text you submitted with personal context (such as your email and company name) removed. You can avoid this by completing a paid order or by asking us to remove it. See the Privacy Policy for details.

8. The Brief and How You May Use It

Subject to your payment, you own the brief we deliver to you and may use it for any lawful purpose, including commercial use within your business.

Because the brief is produced by automated research and AI synthesis from public sources, you acknowledge and agree that:

  • You are responsible for independently verifying any fact, quote, citation, benchmark, or named individual before relying on it or acting on it.
  • A brief is research and analysis, not legal, financial, investment, or professional advice, and not a guarantee of any business outcome.
  • Briefs may identify real individuals and their public statements. You agree to use that information lawfully and respectfully (see Section 9).

9. Acceptable Use

You agree not to:

  • Use the Service or any brief to send unsolicited bulk messages (spam), to harass, stalk, defraud, or harm any individual identified in a brief, or otherwise in violation of anti-spam, privacy, or marketing laws (including CAN-SPAM, GDPR/ePrivacy, and similar).
  • Submit inputs that are unlawful, infringing, or that you have no right to submit.
  • Attempt to access the Service in a manner that circumvents credit limits, rate limits, authentication, or security measures.
  • Reverse engineer, decompile, scrape, or resell the Service itself, or use it to build a competing product.
  • Use the Service to make automated decisions that produce legal or similarly significant effects on individuals without appropriate human review.

We may investigate suspected violations and may suspend or terminate access, withhold or revoke credits obtained through abuse, and take any other action permitted by law.

10. AI Disclaimer

Briefs and triage outputs are generated with the assistance of probabilistic AI models. They may contain inaccuracies, omissions, fabricated or misattributed quotes, outdated information, or other errors. Output is provided for your evaluation and judgment. briff is a research tool, not a source of authoritative fact, and we are not liable for decisions you make based on its output. Always verify before you act.

11. Third-Party Services and Sources

The Service relies on third-party providers and draws on third-party public sources:

  • Subprocessors that help us operate (hosting, queueing, database, authentication, storage, email, payments, and AI model providers) are listed in our Privacy Policy. Their terms and policies apply to their respective processing.
  • Public sources (such as Reddit, Hacker News, and Indie Hackers) are governed by their own terms. Quotes and references in a brief originate from publicly accessible posts. You are responsible for complying with the terms of any source you choose to act upon.

We do not control and are not responsible for third-party services or sources.

12. Intellectual Property

The Service, including its software, design, brand, and the briff name and marks, is owned by [OPERATOR] and protected by intellectual-property laws. These Terms grant you no rights in the Service itself other than the limited right to use it as permitted here. The brief deliverable produced for you is yours as described in Section 8; the underlying systems that generate it are not.

13. Service Availability

We aim to keep the Service available and to deliver briefs on target turnaround, but we provide the Service on an "as available" basis. We may modify, rate-limit, suspend, or discontinue features at our discretion. We are not liable for unavailability, delay, or discontinuation, except as expressly stated in Section 6 where we fail to deliver a paid brief due to our fault.

14. Warranties and Disclaimers

To the maximum extent permitted by law, the Service and all output are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any brief will be accurate, complete, or fit for your intended use.

15. Limitation of Liability

To the maximum extent permitted by law, [OPERATOR] and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising out of or related to the Service or any brief, whether in contract, tort, or otherwise, even if advised of the possibility.

Our total aggregate liability for all claims arising out of or related to the Service will not exceed the greater of (a) the amount you paid us in the three months preceding the event giving rise to the claim, or (b) USD 100.

Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the greatest extent permitted by law.

16. Indemnification

You agree to indemnify and hold harmless [OPERATOR] and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your inputs, your use of any brief, your violation of these Terms, or your violation of any law or third-party right, including the rights of individuals named in a brief.

17. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. On termination, the rights granted to you end, except that Sections 7 through 18 survive. Credits associated with a terminated account for cause may be forfeited.

18. Changes, Governing Law, and Contact

Changes. We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify account holders. Your continued use after changes take effect constitutes acceptance.

Governing law and disputes. These Terms are governed by [GOVERNING LAW], without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction and venue of the courts there, except where mandatory consumer-protection law grants you rights in your place of residence.

Severability and waiver. If any provision is held unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver.
